@TheSnake92 - moved your post into this thread discussing the case. You might pick up some of your answer from earlier responses here.
In the Cheeseman vs Platkin lawsuit what would the removal of the AWB mean for banned by name rifles? Im having M1 carbine FOMO again.
Hopefully, but it depends entirely on how broadly the ruling is issued. Iād probably be picking up an M1 Carbine and a 2011 right away if this were the case.
Iām gonna end up using the current banned list as a shopping list. Finger, toes, and everything in between crossed itās a complete ruling in our favor and not a watered down useless ruling.
M1 carbine and a bm59 are at the top of my milsurp list.
Itās been about 4 months since they heard arguments on this. Was really hoping for a decision before I bought more gear but my permit was nearing expiration. Iāll be happy once we no longer need to neuter mags.
Anyone got a guess as to when we might get a decision?
Yup, sums up my feelings. Sort of worried the same about the carry case they just heard. Weāll turn to dust before hearing anything it seems.
For the Siegel/Koons case, I would be very surprised to see anything from the 3rd Circuit before the Supreme Court rules on Woolford.
Iām hoping the Cheeseman decision comes sooner than that. I would be very surprised if it takes as long as the 2 years that the panel took to come up with their nonsense.
Update:
Current Docket (also updated in top post):
Plaintiffs have filed a 28(j) letter advising the 3rd Circuit about the DC Circuitās mag ban decision:
anyone know where we are on this one and the sensitive place case?
They sure seem to be taking their sweet time ![]()
thats for sure, I starting using NJ gun court cases as my smoke detector replacement scheduling.
Awaiting a 3rd circuit decision.
So to be clear, the 3rd circuit HAS to rule on this before the summer recess on June 30th?
Not to my knowledge. AFAIK Circuit courts have no time limits on when case is heard vs. opinion issued, and no requirement to align issuing decisions in regards to terms.
Koons/Siegel v. Platkin was argued in 2023 and did not receive a merits opinion until September 2025.
