So I was buying a toy for my son and this is illegal in NJ???
Is this true has any one checked with NJSP or NJ atty General?
I know toy guns must have an orange barrel but this doesn’t even have a barrel.
I’ve gotta move.
There is a NJ law enacted in 2019 that puts restrictions on the sale of toy “guns”:
…a toy gun or imitation firearm is required to:
be a color other than black, blue, silver, or aluminum;
be marked with a non-removable orange stripe that is at least one inch in width and runs the entire length of each side of the gun’s barrel; and
have a barrel that is at least one inch in diameter and closed at a distance of at least one-half inch from the barrel’s front end with the same material of which the toy gun or imitation firearm is made; or meets the federal standards for the appearance and configuration of toy guns and imitation firearms established pursuant to 15 CFR 272.1 et seq.
I doubt anyone would try to argue that a TV show “portal gun” would ever be mistaken for a real firearm however online retailers will likely err on the side of being “over cautious” when selling into NJ - they don’t want to risk corporate legal fees in fending off a New Jersey Attorney General suit or fines eclipsing their revenue from selling into NJ.
Thanks! I vote and have ran for elected office. NJ is torturous. You would think that the law would state “if” what is marketed as a “toy” gun has a barrel then all that other stuff would apply. Its nuts I’m always worried i’ll be that guy that buys a toy for my grandson and get a visit from the NJSP. Thanks for info
I really forgot how bad NJ is. I haven’t bought a firearm or ammo here in years. I’ve been buying everything in Florida. I had hoped to be out by now but it looks like another 2 or 3 years. I wasn’t even going to go for my NJ concealed Carry, but than I got to thinking. Why let NJ win? I booked a class for March so I can add my name to the list of people exercising their 2nd amendment right. When I retire in Florida I’m going to frame that NJ Conceal Permit and put it up on my wall in my office.
