NICS wait time?

Heard back this morning

My experience was 1 day.

Like some else stated, as fast as next day

Turn around time is down to one hour. Submitted last night at 5:30, call came back at 6:30.

Because NJ doesn’t do NICS the way it is supposed to be used. In other states, the dealer at point of purchase contacts NICS, and gets an answer back in 10 minutes, more or less.

In NJ, the dealers aren’t allowed to contact NICS directly. They contact the State Police unit, who might wait a day or three before contacting NICS to get the answer back in 10 minutes, more or less, then there is another wait before the State Police reports the result back to the dealer. Massively inefficient, undoubtedly by design. And even more infuriating, if you are buying an airgun, you have to pay the NICS fee in NJ, BUT the NICS won’t waste their time running a check for an airgun purchase, because it isn’t a firearm. So the state pockets the money, and you still have to wait for the State Police unit to come back and pretend that the NICS request has been approved. At least, that is my understanding.

That is absolute BS. How can the state block businesses from using legit government services? I get that NJ wants to have total control, so they can do the illegal gun registry, but to block dealers from engaging in legitimate business with the federal government is criminal.

It would be interesting if a few FFLs just went ahead and used federal NICS and made it a race, to shame the NJSP Firearms Unit…

By revoking your NJ Retail Firearms Dealer Employee License (State License) if you don’t use the NJSP “NICS”:

13:54-3.2 Retail license required

No retail dealer of firearms nor any employee of a retail dealer shall sell or expose for sale or possess with intent to sell, any firearm, parts of firearms, ammunition, or engage in gunsmithing, unless such person has first obtained a retail dealers license issued pursuant to this chapter.

13:54-3.12 Requirements for sale of rifle, shotgun, antique cannon or receiver

Every purchaser, other than a licensed or registered retail or wholesale dealer or manufacturer, or law enforcement agency as provided by this chapter, must present a valid firearms purchaser identification card to the dealer who is required to confirm the identity of the purchaser. The purchaser must also sign a certificate of eligibility (NJSP 634), filled out by the dealer or his licensed employee, for each rifle, shotgun, antique cannon or receiver purchased. The certificate shall indicate that the purchaser presently complies with all of the requirements for obtaining an identification card, and shall set forth the purchaser’s name, address and identification card number. The certificate shall be retained by the dealer. * * * Prior to completing the sale or transfer of a rifle, shotgun, or receiver, the retail dealer shall initiate a NICS check with the Division of State Police. * * *

I mean use BOTH. Use njnics and federal nics. then after some period of time, use that data to sue the state for the unconstitutional delays.

So there would be 2 inquiries into Federal NICS?

One submitted directly by the NJ FFL, and one submitted by NJSP (initiating from the exact same firearm purchase/transfer)?

Don’t think an FFL is allowed to do that…

I applied on a Friday afternoon and it cleared Saturday morning!

Maybe nj nics procedure can be sent to AlinaHabba or Pam Bondi at the US attorney office for Nj for compliance review.

Seems to me that NJ is abusing the system. Isn’t there a gun czar now that is on our side

That’s exactly what I was talking about earlier in this thread. We have been conditioned to believe that a next day approval is good, whereas what it really means is that you are forced to make an unnecessary trip back to the gun store.

That is a good case for unnecessary burden and cost… plus… the additional driving contributes to global warming and kills dolphins.

It also seems like a sneaky way for the state to force an unconstitutional waiting period.

It’s good for FFL’s… guarantees that you make at least two trips in.

My local FFL is $75 for a transfer plus fees. But I put up with it because it’s a 10 minute drive from my house, so 40 minutes total on the road for a transfer. If NICS checks were truly instant… or at least under an hour, I’d be more willing to make a longer drive to save a few bucks and get better service.

One hour was the time mine took, if knew that, I would have gone on the range and did some shooting.

To get the Brady Bill to pass, they had to include an option for the anti-Federal States to become a Point of Contact for the FBI NICS service (PoC). There are many PoC States, but NJ decided to turn it into a cash grab and onerous deterrent. PA is a PoC State, but vastly different in operation. the PASP turn NICS checks around in minutes and are open all weekend.

Maybe we can get ag bondi or alina habba to review exact requirements of POC states, maybe nj has misinterpreted the requirements
