This is a scary read and I’m glad ANJRPC filed this case.
One take-away, if you ever draw/brandish your gun to stop a threat you’d better make a police report so there is at least a chance of “your side” of the story being considered. In this case NJSP filed for and received a TERPO solely based on one complainant in a road rage incident with barely any additional investigation.
I believe TROs are a necessary tool for police, but I think a couple things happen. you get a false accusation or no actual grounds for a TRO but an overzealous or overcautious cop goes ahead and puts it through.
When u combine a crazy ex with an overzealous copper, that combo has jammed up many a dude that did noting wrong.
There needs to be an additional speed bump and above all if someone is falsely accused and and they sic the cops on a dude for no legit reason, they need to be held accountable. The victims of BS TROs need to have some legal recourse.
Police got a TERPO against Kyle Arena because he posted a photo of a hand holding a gun resting on a dashboard.
There is no way to tell if it was his hand, gun, car, or if the photo was even taken in NJ.
It’s a clear misuse of the law which is probably why Nappen took the case.
Believe me you… The law is abused all the time, the only way to keep it in check is accountability. Severe repercussions for complainants and cops that misuse the law is the ONLY way to stop the abuse.
OTOH, Kyle Arena did post pix of himself on FB pointing a gun while driving. They have a go fund me that says “if it can happen to Kyle it can happen to you”. No, it will not happen to me because I’m not stupid enough to point a gun out a car window while driving and certainly would not post something that stupid on FB. Mr Arena invited scrutiny and won a stupid prize.
