My son pointed this out to me. I’m not up to speed on the “other” laws in the state. It does have a brace, but I don’t know where the short barrel fits in the equation. Plus, it’s listed as a “pistol”.
As a pistol is is not legal in NJ. It would fall into the definition of an assault firearm:
ii. A semi-automatic pistol that has an ability to accept a detachable magazine and has at least two of the following:
(1) An ammunition magazine that attaches to the pistol outside of the pistol grip;
(2) A threaded barrel capable of accepting a barrel extender, flash suppressor, forward handgrip, or silencer;
(3) A shroud that is attached to, or partially or completely encircles the barrel and that permits the shooter to hold the firearm with the non-trigger hand without being burned;
(4) Manufactured weight of 50 ounces or more when the pistol is unloaded; and/or
(5) A semi-automatic version of an automatic firearm;
It fails on #1 and #3. I cannot see a weight on PSA’s web site, but I would guess it fails on #4 as well.
However, it could be remanufactured into an AOW by an FFL07 and you could obtain it by doing the NFA paperwork. If you wait until after the end of this year the NFA tax will be $0.
Alternatively, you could purchase a barreled receiver and build an Other off of that. You will just need to confirm with your FFL that they will transfer as an Other/Receiver.
I believe one of the main requirements for an Other is starting off with a “Virgin” unbuilt receiver.
Someone else may be able to chime in with how to affix a brace in order to legally hit the over 26” OAL requirement on an AK.
I would also recommend checking out r/njguns on Reddit. They have a bunch of good Other information over there as well.
Doesn’t EVERY firearm fall into that category in this state, according to the Dems??
I did see in the specs that with the brace extended, it was over the 26" OAL, but I believe that it has to include a 16" barrel, not the 10" on it, to make it a rifle, right? Can it be considered a “other” and not a pistol, that way?
What the law says is what matters, not what the whiney Dems want it to say.
To be a non-NFA Other Firearm, the overall length must be over 26" in it’s shortest configuration. The barrel length is not a factor in itself. If you can block the collapsible stock so the shortest position results in the total length being more than 26" with the 10" barrel you are GTG. You would also need to install a VFG to make it a non-NFA Other. Without the VFG, it would still be a pistol and illegal under NJ law.
Only if you put a rifle stock on it would you also need to have a 16" barrel for it to be a rifle and not an SBR.
Correct. In order for a firearm to be considered an “other” it must:
-from tip of threaded barrel (or muzzle device is p&w) to butt of the buffer tube be over 26” (this is OAL, overall length). This is a difficult requirement to translate over to non-ar15 style firearms. On the ar, the buffer tube is considered a necessary permanently affixed part of the firearm. Therefore, therefore it is doubted that even a permanently affixed pistol brace can contribute to OAL, as it is not needed for the firearm to function. On an AK style firearm, their side folding brace is technically not required to function, but if it’s apart of the rear trunnion, and then permanently affixed to be open, it might be? This is where I’m not sure enough to give solid advice. Try maybe reaching out to Superant Arms or Trinity Armament.
-must contain a VFG (vertical fore grip)
-must not have a rifle stock. Pistol braces are fine
The thought process behind this is: With no rifle stock, it “can’t be shouldered” and therefore is not a rifle. With a VFG it is not a pistol as it’s designed to be fired with two hands. With a rifles barrel it is not a shotgun. With a OAL>26” it is not “easily concealable” and therefore not an AOW.
This is the general rule of thumb when building an Other. To be safe on with the AK, I would wait till Jan 1st and AOW it. It’ll let you get a side folder which would be sick, and there would be no grey area with OAL.
Easiest way to do this would be to have your FFL permanently affix the magazine to the pistol variant. This would allow them to transfer the firearm to you as a fixed magazine pistol, which does not fall under the AWB. You can then submit the NFA Form 1 paperwork yourself post Jan 1st for free. Once approved, bring the fixed magazine pistol to get engraved and then you can remove the mechanism permanently affixing the magazine. Please reference the link below for a massive AOW information dump on r/njguns.
Honestly. The best option for any firearm like this that doesn’t need a buffer tube in NJ, convert it to AOW. You can then put folding brace or whatever brace setup on you want. No need to worry about pin/weld or pin brace etc.
I will say the akv is fun to shoot, just hefty. I sold my akv and got a Stribog sp9a3.
That’s kinda my concern, with a AOW, and maybe I’m being too paranoid, but getting jambed up by a LEO who doesn’t understand all the nuances of the AOW.
That’s why it looked interesting, and it appears to accept the Scorpion mags, which I already have. But I tried to find the weight, and they didn’t have it listed. Any guesses to what it weighs?
Wow… That’s heavy. I like pistol caliber carbines, as they’re sometimes lighter, and I like light. I converted my Scorpion to a Bullpup, to make it a smaller package, but it really didn’t make it lighter. It ended up really bulky and heavy too.
I have a couple ar9 others. Easy to put together and they are well balanced and relatively light. Stribog / kuna/ ap5 k are all pretty light but best suited as AOW.
