Fake Silencer Barrel Cover/Shroud

Does anyone know is this is legal my local gun shop said it would have to be pinned on. I said it just slides over the existing 16inch barrel of a rifle as a cover or shroud. They of course said it doesn’t matter. I said it its like a fore end cover on a ar15 it just covers the barrel. They insisted it would need to be pinned?

Thoughts?

The description says this:

This item slides over your existing 16" barrel and hides the barrel and muzzle device. It is held in place by 4 set screws towards the rear of the barrel shroud.

It does not screw onto threads on the barrel so has nothing to do with the threaded barrel legal restrictions.

  1. Any firearm manufactured under any designation, which is substantially identical to any of the firearms listed in paragraph 1 above. As used in this definition, the term “substantial” means pertaining to the substance, matter, material or essence of a thing and the term “identical” means exactly the same. Hence, a firearm is substantially identical to another only if it is identical in all material, essential respects. A firearm is not substantially identical to a listed assault firearm unless it is identical except for differences that do not alter the essential nature of the firearm.

The following are examples of manufacturer changes that do not alter the essential nature of the firearm: the name or designation of the firearm; the color of the firearm; the material used to make the barrel or stock of the firearm; the material used to make a pistol grip; and a modification of a pistol grip. This is not an exclusive list. A semi-automatic firearm should be considered to be “substantially identical,” that is, identical in all material respects, to a named assault weapon if it meets the below listed criteria:
i. A semi-automatic rifle that has the ability to accept a detachable magazine and has at least two of the following:

(1) A folding or telescoping stock;

(2) A pistol grip that protrudes conspicuously beneath the action of the weapon;

(3) A bayonet mount;

(4) A flash suppressor or threaded barrel designed to accommodate a flash suppressor; and

(5) A grenade launcher;

Note that the admin code says you cannot have 2 of the prohibited features. Let’s count what you have with a PS90.

(1) A folding or telescoping stock; - nope. Fixed stock

(2) A pistol grip that protrudes conspicuously beneath the action of the weapon; - nope, no pistol grip at all

(3) A bayonet mount; - still nope, not there

(4) A flash suppressor or threaded barrel designed to accommodate a flash suppressor; - yep, got one of those

(5) A grenade launcher; - nope

So even if the FFL is correct in thinking that this device counts under #4, it doesn’t matter because none of the other evil features are on this type of rifle. Your evil feature count is 1.

Is the flash hider that came with the rifle pinned? It doesn’t need to be.

Thanks Thats what i thought! Thanks for the clarifications as you counted them that seems to make sense. Again yes the PS90 has a barrel 14.8 inches with if you will a secondary barrel cover and integrated muzzle brake all of which is is pinned to he barrel, creating an over all 16inch barrel. There is no way to remove shroud or barrel without either cutting the barrel and shroud and or drilling out pin etc.. So I would think it needed to be pinned to meet the 16inch requirement and not become I guess a SBR?

The PS90 has a barrel with a muzzle brake pinned on already - that satisfies the barrel length requirement. Adding on a screw on fake suppressor doesn’t make it another barrel - it’s simply a cosmetic accessory.

I have one on my Cx4 - it’s attached via a couple screws underneath (silver hole you see) - just slides over the barrel. Cosmetic only. Does not have to be pinned.

If it’s a screw on it’s probably an issue if it threads on as threaded barrels are a no no.. this is held on by set screws they are totally legal

Threaded barrels are a no-no only if you have another evil feature such as the pistol grip. The PS90 has no pistol grip, so if the barrel was over 16" having it threaded would be fine. Similarly, a threaded barrel on a Mini-14 is legal when it has a traditional rifle stock and you can have a bayonet on an SKS.

While I’m at it does adding the dorin 3 way selector found on fn specialties 3 way selector illegal just curious since im in a rabbit hole of adding useless accessories. It states. However that is a federal level not NJ “Legal Notice: This selector does not convert a semi-automatic firearm to full-auto. It does not alter your fire control group or firearm classification.”

If it has no effect on the firing mode (one shot per one pull of trigger - NJ definition) then I’m not aware of any NJ legal issues with it.

Could possibly be a “you mind explaining this?” situation if you happen to run into a range officer/LEO who is familiar with PS90’s at a range.
