They are still enforcing their interpretation that some braced pistols qualify as unregistered SBRs.

And that uncertainty is where things get dangerous.
Because when enforcement comes down to interpretation, it’s not just about what the law says. It’s about how it’s applied. And according to this filing, the ATF hasn’t backed off one bit.
No. Pistol braces are not felonies. Some things sold as pistol braces are not, avoiding to the atf, pistol braces. Thus they are stocks and you’d be manufacturing an sbr and could catch a felony. Additionally what is and is not a brace can change at the ATF’s whim even if there manufacturer got an evaluation letter from the atf.
This is how it was when the first brace hit the market it’s nothing new
It has a determination letter, that letter doesn’t mean shit in court and never did, and it pretty much comes down to if the ATF wants to charge you. But if they charge you, you can mount a defense and they will not have a clear rule that is black and white about it being illegal. Braces have always been an “at your peril” kind of thing. Jsut the degree of peril has gone up and down. It is currently on the down side, but that down side has never been zero.
Absolutely. The core of “other” is that it is not a pistol and not a rifle. The way other’s generally get there is being designed to fire with two hands, and NOT being designed to be shouldered. If your brace is not a brace, then your other is not an other.
But shouldn’t it go by the same classification as a muzzle device? If it’s promoted as a flash hider it’s illegal in NJ. So if a brace is promoted as a brace, shouldn’t that be recognized the same way?
