Am I alone in thinking GVR here could be a problem? This nonsense has been going on long enough…

Nope. A gvr would go back to the third. Unless they suddenly get really speedy, even though we’d likely prevail, that’s another year. Then another appeal by the state to SCOTUS. Which may take another year to get a ruling even if they grant without any delay.

It could happen.

I don’t think it will though. I think there’s going to be a strong message sent to defiant inferior courts.

I think that will take one of two forms.

One is that with cert finally requested by the state, that Platkin gets merged with Duncan and heard this term. That the ninth’s reasoning is excoriated, probably by every justice rolling with the majority, and with a bonus of ACB calling out KBJ’s inevitably retarded dissent.

The slightly lazier and more polite version would be to hold both cases until after viramontes. That it gets a general hardware test and some clarity on applicable eras for history and tradition as well as a real clear statement on interest balancing and the States’ burden on 2a cases and then deny the state’s appeal of Platkin and summarily reverse the ninth circuit.

The simplest solution is for the Supreme Court to just deny cert.

The 3rd Circuit opinion explains how and why they got it wrong every time they saw this case before and why their reasoning is now in line with SCOTUS by following Heller, Bruen, etc. all the way through Wolford. They finally got a well reasoned decision (written by a Dem appointee no less)

The Supreme Court should endorse the decision we already have by letting it stand. The stay is dissolved automatically by a denial of cert.

This is the way.
