If they leave room for feature bans, that actually makes things worse for us. NJ already has a new version cooked up that bans anything with at least ONE evil feature.
Rumor - have no other information other than this quote:
Just a heads up for anyone who may have bought magazines over 10 rds, I was at recoil yesterday in a class, and the person from U.S. law shield came in to talk to us, and told us that someone was pulled over with a 30rd mag last week and was charged and U.S. law shield did not cover them because it was still illegal.
Another recent “high capacity” magazine charge - Washington Twp (leaving out name of accused):
A Georgia motorist towing a boat trailer without a license plate was also carrying a loaded gun when he was stopped by a Washington Township police officer, authorities said.
…
…remained held in Bergen County’s jail today (Tuesday), charged with unpermitted possession of a handgun and possession of a large-capacity magazine. …
any chatter on any 3rd circuit cases? sensitive places and such
They’re waiting for us all to die off old age.
cant the complaintints ask the SC to speed things up, I thought thats why the 3rd circuit heard the rifle/mag ban case
Now we wait some more.
Best possible (but probably least likely) outcome - SCOTUS denies the appeal.
No the least likely outcome is they take the case and find in favor of the state.
An immediate denial would be nice though.
Neither case currently before SCOTUS addresses the magazine issue. Can SCOTUS separate the cases? Can they just take the feature ban part of the case and let the 3rd circuit ruling on magazines stand?
Our best result would be a denial of cert.
If I’m understanding the experts, somehow the mag case will get pulled into or piled on top of several 2A cases that will be heard and settled once and for all. All with one deft blow. Until these all align just right, we will see some of procedural stuff. Dong 'em all at the same time, or in quick succession s to NOT give the anti’s room to breath and use whatever tomfuckery they can come up with to complicate the remaining cases…
The below is from an ongoing “discussion” with Grok about the several cases.
New Jersey filed its petition for a writ of certiorari on or about October 1, 2026 in Davenport v. Association of New Jersey Rifle and Pistol Clubs (the Third Circuit en banc case).
The petition presents two questions:
- Whether the Second and Fourteenth Amendments prohibit restrictions on semi-automatic assault rifles.
- Whether they prohibit restrictions on large-capacity magazines.
New Jersey’s explicit request is the standard one in this posture: hold the petition pending the Court’s decision in the already-granted Viramontes/Grant AR-15 cases, then (if appropriate) grant, vacate, and remand in light of that decision. That keeps the Third Circuit’s stay of its mandate in place and preserves the bans as enforceable law in New Jersey for the time being.
No surprise at all. This is the textbook delay-and-preserve-status-quo move. Filing at the last practical moment (rather than seeking an extension into December) still buys them the full period until SCOTUS acts on the petition after Viramontes is decided next summer. The bans remain operative throughout.
The September 28 long conference results on the other magazine petitions (Duncan, Gator’s, etc.) have not yet produced public orders that change the picture in a major way; those remain the other key variables still outstanding.
2055 couldn’t come soon enough
Being a little optimistic there aren’t you pardner?
Ouch!
Right! I’ll probably be gone by then. Maybe my teenager will benefit when they retire.
The machines will be in charge, we will have flock 2 way televisions in each room keeping an eye on us. anyone who is caught secreting an old paper copy of what was know as the US Constitution shall be removed for re-education.
Sorry for being a little testy there, but I recently acquired an older Browning hi power 9mm and need to pick up a few more mags. Don’t like having to wait until I have permission to get standard magazines until the previous 2A victory is actually a victory.
