The gun control package from the spring is being introduced to the Senate Law and Public Safety Committee this Thursday.

If you click on Membership, please immediately email all members of this Senate committee and tell them to vote no on all measures.

“Machine gun conversion device” means any plastic or metal device or any part or combination of parts designed and intended to be used to modify a semiautomatic firearm to shoot more than one shot with a single pull of the trigger.

A4975 - NJ Legislature

“Firearm digital instructions” means digital instructions in the form of computer-aided design files or other code or instructions stored and displayed in electronic format as a digital model that may be used to program a three-dimensional printer to manufacture or produce a firearm, firearm receiver, magazine, or firearm component.

A4796 - NJ Legislature

A person commits a 1[crime of the fourth degree] disorderly persons offense by recklessly discharging a firearm using live ammunition rounds unlawfully or without a lawful purpose [in a manner other than as provided in subsection a. of this section] , except that a second conviction for such an offense constitutes a crime of the fourth degree, and a third or subsequent conviction for such an offense constitutes a crime of the third degree

1c. A person who commits a violation of subsection b. of this section shall be charged with a crime of one degree higher than what ordinarily would be charged for such offense, where the violation
occurs within 100 yards of:
(1) an occupied structure; or
(2) a school, college, university or other educational institution, school bus, or child care facility, whether or not occupied.

A map or true copy of a map depicting the location and boundaries of the area within 100 yards of any property subject to this subsection may be used in a prosecution under this subsection.

f. It is an affirmative defense to prosecution if while engaging in conduct prohibited under this section, the actor was acting otherwise in lawful self-defense.

A4798 - NJ Legislature

The prosecutor of each county shall collect, record, and report data to the Attorney General concerning a crime or, in the case of a juvenile, an act which if committed by an adult would constitute a crime involving the use of a firearm, as defined in subsection f. of N.J.S.2C:39-1, that did not result in bodily injury.
b. The prosecutor of each county shall provide information to the Attorney General regarding criminal complaints pursuant to subsection a. of this section, which shall include:
(1) the complaint number;
(2) the date and time of the incident;
(3) the location of the incident, including the county, municipality, and address;
(4) the statutory citation and degree of all offenses charged; and
(5) whether the defendant lawfully or unlawfully used the firearm subject to the charge.
The prosecutor of each county shall provide the information required in this subsection for criminal complaints, regardless of whether the case is prosecuted, dismissed, or downgraded.

A4981 - NJ Legislature

… The court shall consider the Pretrial Services Program’s risk assessment and recommendations on conditions of release before making any pretrial release decision for the eligible defendant; provided however, that upon request of the prosecutor, the court may take additional time than established pursuant to this section if the eligible defendant is charged with any crime or offense involving the use or possession of a firearm, but the additional time provided for shall not exceed such time as is reasonably necessary for a firearms ballistic analysis to be conducted and immediately provided to the court, and in no event shall exceed seven days

These people never amaze me with the bullshit that they want to pass into laws.

If they spent half as much time trying to solve problems for the citizens of NJ as they do trying to infringe on our rights, we might have a decent State.

I was thinking a4975 was to make 3D gun’s illegal.. it’s becoming huge in other states.
I don’t understand some of these, it’s just so over the top like why do Merchant codes for fireams and ammunition?

So democrats can track when and how much ammo/guns you are buying using data mining of retail marketing data that they can buy, circumventing illegal registries and without violating privacy laws.

Oh I know it’s ridiculous and overstepping, they don’t care what the bad guys are doing but what the law abiding citizens are doing. Keep their thumb down on the people who are supposed to be free.. I h8NJ

Today’s the day, starting in ~15 minutes, for the committee meeting on these.

Just to provide a quick update from today’s NJ Senate hearing, all seven bills were passed in the committee and referred to the Senate floor.

We did score a few victories that are worth noting.

On the possession of 3D printer files bill, the bill was amended to requiring an intent element so simply possessing these files is not enough to be prosecuted. There must be an intent to manufacture a frame or receiver in addition to the possession of those files.

On the Discharge of a Firearm bill, several amendments were made. An initial charge under this law has been knocked down from a 4th degree misdemeanor to a disorderly persons offense. In addition, the bill text now excludes circumstances involving lawful self defense.

On the pre-trial detention bill, language was added to require that if a prosecutor seeks additional pre-trial detention, that additional time to cannot exceed 7 days.

It’s hard to call these actual victories, but in environment where democratic lawmakers can steam roll us on legislation, the small victories are all we can hope for.

The machine gun conversion device bill went through with no amendments. It was clear in the hearing that this has nothing to do with public safety or getting glock switches off our streets. This has everything to do with creating ambiguities so that the AG can classify anything it wants as a “machine gun conversion device.” This has everything to do with the AG’s recent lawsuit in Maryland and the topic of forced reset triggers came up in the hearing.

On timing, we should know tomorrow afternoon as to whether any of these bills are going to get fast tracked.

On Thursday, June 19th, the Senate Law & Public Safety Committee passed a package of anti-gun bills adopted by the Assembly back in March. The bills all advanced from committee on party-line votes, with the committee Democrats supporting.

The NRA provided testimony highlighting the redundancy of the legislation and the severity of the penalties. Nearly all the bills were amended, in some instances providing important exemptions for cases of lawful self-defense. However, even with the amendments, the legislation is still unnecessary, infringes upon the rights of gun owners and warrants opposition.

The bills now head to the Senate floor, where they can be taken up for a vote at any time. Your immediate help is needed! Please contact your Senator using the TAKE ACTION button below and respectfully ask them to reject all gun control bills, including the following:

[S.1558] makes it a first-degree crime (up to 20 years in jail) to transport, ship, or even dispose of a firearm without a serial number. There is no exception for previously owned historical firearms that were lawfully manufactured and lawfully acquired without a serial number.

[S.3893] prescribes penalties for the sale and possession of “machine gun conversion devices.” Such devices are already banned at both the state and federal level.

[S.3894] creates a crime for possession of digital instructions to illegally manufacture firearms or firearm components. This legislation creates a crime even if someone never produces a gun or component. Simply having a digital file for a component on your computer makes you a criminal.

[S.3706] mandates the use of Merchant Category Codes. This is nothing more than government-sanctioned snooping that can be used to create a firearms registry or discriminate against gun owners and lawful businesses.

These gun bills are completely unnecessary! It’s time to tell the politicians to leave law-abiding citizens alone and focus on enforcing the laws already on the books. Please Take Action Now by utilizing the TAKE ACTION button above!
