It will be interesting to see how this plays out. My questions are why was he fumblefucking with the gun? What kind of holster? How is he charged with prohibited carrying? He has a permit and the place does not serve alcohol.

True but we’re all required to do that to go into a sensitive place unless they’re charging him for doing something stupid.

You are assuming he had a holster. He may have just thrown his gun into his pocket - very dumb and not a legal way to carry.
He also clearly had his finger on the trigger at some point, too. He’s going to face some serious consequences for being a dumbass.
I hope the lady makes a full recovery and the rest of us don’t get slammed for “the actions of just 1 person.”
I read on farcebook that the restaurant recently started serving beer and wine. He should have returned to his car. Even if he ND’d there maybe no one would have gotten injured.
They do serve beer so that’s probably the prohibited carry charge

Agreed. Cindy and I went to an unfamiliar restaurant and I checked their website to see if they served alcohol. There was no mention of alcohol service on their website. When we entered I saw the full bar and excused myself and returned to the car to put my firearm unloaded in my safe.

The law is dumb, but that has nothing to do with what his guy did.
He was carrying his holstered gun in a so called sensitive area. Unloading it in that sensitive area doesn’t change the fact that he is possessing a gun in a prohibited place. He took out his gun and tried to rack out a round with his finger on the trigger. He is a dumbass.
It was explained in Heller that the right to bear arms carries risk, but the founders have considered that risk and decided the right to bear arms was more important for all of the people despite the risk that dumb people will do dumb things. Even dumbasses get to exercise their 2A rights. However, they also get to face the consequences of their dumb actions.
I’m sorry this lady got shot and I hope she makes a full recovery. I also hope the dumbass has enough resources to pay her reasonable compensation.
If anything, I can imagine this being used as argument for the liability insurance that is currently enjoined.
It looks like the predictions about a ND as a result of requirements for frequent loading and unloading CCWs has come true. Statistically, the way the democrats set up the laws, was going to eventually lead to a ND because it puts hands on the firearm at a higher rate of frequency. Even things that are avoidable can be inevitable, and I think the dems were just waiting for it to happen. Perhaps even encouraging it to happen by forcing CCW holders to mess with their HGs
NJ101.5 picked up the story in their brief news announcements. I stop listening before Bill gets on the air, so I don’t know if it was discussed beyond the 20-30 second mention of it.
Bad situation all the way around. Even if the guy safely unloaded and kept the gun on his person, I assume he’d still be breaking the law. Furthering my lack of understanding why he was trying to unload inside the restaurant with other people around.
I saw a news report that said he was “showing off his gun” to his friends.
The short version is he was a dumbass.
The long version is he was an incompetent dumbass who doesn’t care enough to keep his finger off the trigger.
I have been an instructor and match director for over 12 years and have lost count of the number of people who can’t keep their boogerhook off the bang switch. What makes it worse is many of them deny even having done it when corrected.
This is exactly why when I have to go into a sensitive place, I take off my firearm and holster as one unit, and lock it up while still in its holster. This way I’m not unnecessarily messing with my firearm trying to unload it and messing with it thereby increasing the risk for an ND.
