ANJRPC v. Platkin - Assault Weapons Ban - 3rd Circuit Court of Appeals

Is it just me or has anyone else noticed the dearth of news coverage about this?

The only thing I have seen in mainstream news was a short article on NewsMax. Naturally all the 2A sites are plastered with the decision. I was expecting 24/7 caterwauling from MSDNC and the View. Perhaps the democrat-socialist media is leaving it alone until they get their instructions from Soros.

Your arguments make perfect sense to me and I’m sure our side will be making the same or similar arguments to oppose a stay. Ok I’m done being negative, positive thoughts from here on out :crossed_fingers:

You missed the point. The stories can be found if you look for them. Why isn’t this on televised news? why is this not a headline on news sites… why do we have to look for the story.

No. The .50 cal law is a sepaparate issue.

The majority of the media is controlled by Liberals.

Correct, as are the issues of handguns and shotguns being banned. That is why the 3rd tossed back to the lower court to make revsions because the opinion includes guns beyond the AR-15. So, if they are reconsdering handguns and shotguns that were banned, will the 50BMG be included in that reconsideration. If not, why not. the 50 cal was banned using the same arbitrary categorization. That’s entirely what anjrpc v platkin is based on, they cant just make up a name for something and ban it.

No because iirc, the 50 BMG ban is not part of the assault weapon statute. Its a banned weapon just not an “assault weapon.” The shotgun and pistol issue will be resolved in the lower court because there are shotguns and pistols that fall under the AW statute, if that makes sense.

The great thing about this ruling is will affect states outside NJ.

Ok so what are the odds that CA, NY, CT, etc… AGs are calling NJ AG telling her she better not appeal to SCOTUS?

That’s what I thought too but from what I’m reading, it doesn’t automatically apply to DE, even though DE is also in the 3rd circuit. They still have to wait for their own suit to make it’s way through the court system at which point it’s a guaranteed certainty that their AWB will be overturned as well. Dumb waste of time.

You didn’t really see much on Sat/Sun because newsworthy sports were still on, the World Cup and the British Open Golf.

Didn’t Mark Smith do a video on that issue, hoping the 3rd Circuit would wait until the DE Supreme Court rules on the Delaware law. Mark said it was a supremacy cause action, the 3rd Circuit is above a state supreme court.
